Rubbish Removal Putney Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Removal Putney provides rubbish removal and waste collection services. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Client means the person, company or organisation requesting the services.
Company, we, us or our means Rubbish Removal Putney, the provider of the waste collection and removal services.
Services means the rubbish removal, waste collection, clearance and related services provided by us as agreed with the Client.
Waste means any items or materials requested to be collected by the Company, subject to the restrictions and exclusions contained in these Terms and Conditions and applicable waste regulations.
2. Scope of Services
2.1 We provide rubbish removal and waste collection services for domestic, commercial and other lawful premises.
2.2 Our services may include the collection, loading, transportation and appropriate disposal or recycling of waste in accordance with applicable UK waste legislation and guidance.
2.3 We reserve the right to refuse to collect any items that we reasonably believe may be hazardous, prohibited, unlawful, too heavy, unsafe to handle, or not in accordance with these Terms and Conditions or relevant waste regulations.
2.4 Any description of our services given on our website, by email, in writing or verbally is for general guidance only and does not form a binding commitment to perform services in a particular way or at a particular time, save as expressly agreed in writing.
3. Booking Process
3.1 Bookings may be made by telephone, email, or through any online booking system we make available.
3.2 When you request a booking, you must provide accurate and complete information, including but not limited to the type and approximate quantity of waste, access details, property type and any special requirements.
3.3 Any quote provided prior to the collection is based on the information supplied by you. We reserve the right to revise the quote if, upon arrival, the nature, volume or weight of the waste differs from that described, or if access or site conditions are materially different from those stated at the time of booking.
3.4 A booking is only confirmed once we have provided you with a confirmation by email, text message or other written means. We may decline any booking request at our sole discretion.
3.5 You are responsible for ensuring that someone with authority is present at the premises during the agreed collection window to grant access, confirm the waste to be taken and approve any variations to the service or charges.
4. Pricing and Quotes
4.1 Our charges may be based on factors including, but not limited to, the volume of waste, weight, labour time, access conditions, parking arrangements, type of waste and disposal costs.
4.2 Any price or quote given before we arrive on site is an estimate only and not a fixed price, unless we expressly state that a fixed price has been agreed following a detailed assessment.
4.3 If the waste is more or less than estimated, or if additional work is required, we will inform you of any change in price as soon as reasonably practicable. If you do not agree to the revised price, we may cancel the service in accordance with these Terms and Conditions, and you may be liable for a call-out or cancellation fee.
4.4 All prices quoted are exclusive of any applicable taxes, charges or levies unless stated otherwise. You are responsible for any such additional costs.
5. Payments
5.1 Payment is due on completion of the services, unless otherwise agreed in writing in advance.
5.2 We may accept payment by cash, debit card, credit card, bank transfer, or other payment methods as notified to you.
5.3 Where we agree credit terms with a business Client, payment must be made within the agreed payment period from the date of our invoice. If no period is agreed, payment is due within 14 days of the invoice date.
5.4 We reserve the right to require full or partial payment in advance or to take a card pre-authorisation before carrying out the services.
5.5 If payment is not received when due, we may charge interest on the overdue amount at the statutory rate applicable in England and Wales, as well as reasonable costs incurred in recovering the debt.
6. Cancellations and Amendments
6.1 You may cancel or amend a booking by giving us reasonable notice via telephone or in writing.
6.2 If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will usually be charged, unless we have incurred specific costs in preparation for your service.
6.3 If you cancel less than 24 hours before the scheduled collection time, or if we are unable to access the premises or proceed with the collection due to circumstances within your control, we may charge a reasonable cancellation or call-out fee to cover our costs.
6.4 We reserve the right to cancel or reschedule a booking if we are prevented from performing the services due to circumstances beyond our reasonable control, including but not limited to severe weather, traffic disruption, vehicle breakdown, staff illness, or compliance with legal obligations. In such cases, we will aim to notify you as soon as reasonably practicable and will offer an alternative appointment where possible.
6.5 We are not liable for any loss or damage you may suffer as a result of such cancellation or rescheduling, provided we act reasonably and in accordance with these Terms and Conditions.
7. Client Responsibilities
7.1 You must ensure that we have safe and reasonable access to the waste and to the property, including suitable parking arrangements for our vehicle within a reasonable distance of the collection point.
7.2 You must obtain any necessary permissions, permits or consents required for vehicle access, parking, or waste removal from your premises. Any parking charges, fines or penalties incurred due to incorrect information or failure to obtain necessary permissions may be charged to you.
7.3 You must ensure that all waste presented for collection is accurately described, not hazardous (unless previously agreed and appropriately packaged), and reasonably accessible for loading. Sharp, heavy or awkward items must be safely positioned to prevent injury or damage.
7.4 You are responsible for removing or securing any personal or valuable items that you do not wish to be taken. We are not responsible for items removed as waste where it was reasonable for us to assume that they formed part of the rubbish to be collected.
8. Waste Regulations and Prohibited Items
8.1 We operate in accordance with applicable UK waste management legislation and environmental regulations. We are committed to lawful, safe and responsible handling, transport and disposal or recycling of waste.
8.2 We will not collect certain types of waste unless specifically agreed in advance and compliant with relevant regulations. Prohibited or restricted items may include, but are not limited to, hazardous chemicals, asbestos, clinical or medical waste, pressurised containers, explosives, fuel, gas bottles, and certain electrical or electronic items requiring specialist treatment.
8.3 If we arrive on site and discover that the waste contains prohibited items or substances that pose a health, safety or environmental risk, we may refuse to remove them and may either cancel the service or agree an adjusted service and price, subject to availability and legal requirements.
8.4 Title and responsibility for the waste transfer from you to us at the point that the waste is loaded onto our vehicle. From that point, we are responsible for managing the waste in accordance with applicable law.
8.5 Where required, we may provide appropriate transfer notes or documentation to evidence lawful transfer and disposal of waste. You are responsible for retaining such records where legally required.
9. Liability and Insurance
9.1 We will exercise reasonable care and skill in providing the services. However, our liability is subject to the limitations set out in this section.
9.2 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.
9.3 Subject to clause 9.2, we are not liable for any indirect, consequential or economic loss, including but not limited to loss of profits, loss of business, loss of opportunity, or loss of data, arising from or in connection with the services or these Terms and Conditions.
9.4 Our total liability to you for any loss or damage arising out of or in connection with the services, whether in contract, tort including negligence, breach of statutory duty or otherwise, shall not exceed the total price paid or payable by you for the specific service giving rise to the claim.
9.5 We are not liable for any pre-existing damage at your premises or to your property, nor for any damage resulting from defects or weaknesses in the structure, fixtures or fittings, including but not limited to loose flooring, fragile walls, or poorly installed fittings.
9.6 You must notify us in writing of any alleged damage or loss as soon as reasonably practicable and, in any event, within 7 days of the service. You must give us a reasonable opportunity to inspect, investigate and, where appropriate, rectify any issue.
9.7 We maintain appropriate insurance cover in relation to our services and operations. Details of our insurance can be made available upon reasonable request.
10. Complaints and Disputes
10.1 If you are dissatisfied with any aspect of our services, you should contact us as soon as possible, providing full details of your concerns.
10.2 We will acknowledge and investigate complaints promptly and aim to resolve them in a fair and reasonable manner.
10.3 If we are unable to resolve a dispute amicably, either party may seek legal remedies in accordance with the governing law and jurisdiction set out in these Terms and Conditions.
11. Force Majeure
11.1 We are not liable for any failure or delay in performing our obligations under these Terms and Conditions where such failure or delay results from events, circumstances or causes beyond our reasonable control.
11.2 Examples of such events include, but are not limited to, extreme weather, natural disasters, public emergencies, acts of war, terrorism, strikes or industrial disputes, government restrictions, utility failures, and major transport disruptions.
11.3 In such circumstances, we may suspend the services for the duration of the event or, where necessary, cancel the affected booking. We will use reasonable endeavours to notify you and to resume or reschedule services once it is reasonably practicable to do so.
12. Data Protection and Privacy
12.1 We will collect and process personal data in connection with your booking and the provision of services in accordance with applicable data protection legislation in the United Kingdom.
12.2 Personal data may be used for purposes including managing bookings, providing services, processing payments, communicating with you, and meeting our legal obligations.
12.3 We will take reasonable steps to keep your personal data secure and to prevent unauthorised access or disclosure. We will not sell your personal data to third parties.
13. Variations to these Terms
13.1 We may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will normally apply to that service, unless we mutually agree otherwise in writing.
13.2 We may publish updated terms on our website or otherwise make them available to you. Continued use of our services after any changes take effect will constitute acceptance of the updated terms.
14. Severability
14.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision will be deemed deleted or modified to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
15. Governing Law and Jurisdiction
15.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation are governed by and construed in accordance with the laws of England and Wales.
